Mauritius trust and fiduciary business regulation
Mauritius Financial Services Commission pages describe which management companies may act as trustees, the categories they publish, and application materials. They also direct readers to a register of licensed management companies.
Who regulates trust service providers
The Financial Services Commission of Mauritius licenses Management Companies to provide specified corporate services and to act as corporate trustees or qualified trustees under the Trusts Act. The FSC describes Management Companies as intermediaries between clients and the Commission. Management Companies may provide trust formation, administration and trusteeship services.[1]
Management companies also have obligations connected with client checks and records. These companies collect and verify necessary client information while performing customer due diligence, then retain information for submission to the FSC when requested.
Published licensing categories
The FSC codified list identifies two Management Licence entries under corporate and trust service providers. FS-3.1A is titled Management Licence, while FS-3.1B is limited to qualified or corporate trustees. The list gives both a processing fee of USD 700 and a fixed annual fee of USD 6,800.
Authorisation under the Trusts Act is listed separately. It identifies TAC-1.1 as authorisation for a qualified trustee other than a Management Company. It also includes entries for an enforcer and a successor to an enforcer where a purpose trust was created by a Mauritian national only.
The register of licensees
The FSC directs readers to its Register of Licensees for the list of licensed Management Companies.[1]
Applying for a licence
For a licence under the corporate and trust service provider section, the FSC says applicants submit a complete set of documents so it can process the application.
FS-3.1A and FS-3.1B are Section 77 entries, and the qualified trustee authorisation is a Trusts Act entry under Section 2.[1][2]
Management Companies are the channel through which an applicant submits an application for a Global Business Licence. Management Companies may use the Online Submissions Platform for Global Business Licence applications.
