Belize trust rules and U.S. reporting

Belize legislation describes international trusts, including registration, trust agents and tax treatment. IRS rules separately govern reporting by U.S. citizens connected to foreign trusts.

How Belize law defines an international trust

Belize's Trusts Act sets a specific framework for international trusts. To qualify under that part, the settlor and all beneficiaries must be nonresidents of Belize, the trust property cannot include Belize land, and Belize law must govern the trust. A purpose trust must have a purpose pursued outside Belize.[1]

The Act requires an international trust to be created in writing. It identifies registration details that include the trust name, settlement and registration dates, trustee, any protector, and the trust agent's name and address.[1]

Registration and local trust agent

A settlor, trustee or trust agent is responsible for applying to register the trust within 90 days after its creation. The Registrar may extend that period when satisfied that nonregistration resulted from inadvertence by an intended party. An application must include the required registry information and an affidavit from the trust agent.[1]

An international trust must have a trust agent resident in Belize, appointed by its trustee. The agent accepts service of legal process for the trustee and any protector, and is responsible for ensuring compliance with statutory registration provisions and regulations. The Act also requires the agent to hold a licence issued by the Commission to engage in trust business.[1]

Belize tax treatment in the Act

The tax provision applies when an international trust is duly registered and remains registered under the Act. In that case, the trust is exempt from the Income and Business Tax Act. The same section separately addresses estate, inheritance, succession or gift taxes and stamp duty for trust property and related instruments.[1]

For exchange-control purposes, the Act treats a registered international trust's trustee as not resident in Belize in relation to the trust property and transactions conducted for the trust. This specific treatment concerns exchange control.[1]

The Belize Tax Service Department describes its Business and Income Tax system as applying to business earnings and individual income. Its listed categories of persons and entities who must pay include self-employed individuals, companies and partnerships, and professionals.

U.S. reporting for U.S. persons

Belize registration and tax classification do not replace U.S. rules. The IRS defines a U.S. person to include a U.S. citizen and says foreign trust transactions, ownership and distributions can trigger income tax consequences or information reporting. Which obligations apply depends on the person's connection to the trust and the transaction involved.[5]

The IRS describes Form 3520 reporting for U.S. persons who create or fund a foreign trust, receive a distribution, or are treated as its owner under grantor trust rules. A U.S. person treated as an owner may also have to ensure that the foreign trust files Form 3520-A and provides annual statements. If the trust does not file, the owner completes and attaches a substitute Form 3520-A to a timely filed Form 3520.[5]

The IRS says a U.S. owner of a foreign trust is generally taxed on trust income under the grantor trust rules. A U.S. beneficiary receiving a distribution from a foreign nongrantor trust generally reports the beneficiary's share of distributable net income. These federal rules operate alongside, and separately from, the Belize provisions summarized above.[5]
